All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />New Elk Coal Company is requesting approval of a mine plan to extract coal from the Apache coal seam or the <br />Allen coal seam to the southeast of the mine facility under the Bosque del Oso State Wildlife Area. The surface <br />and the coal in the proposed expansion area is owned by the Division of Wildlife. The underground coal mining <br />operation is on land located approximately 25 miles West of Trinidad, Colorado. The permit area is further <br />described as follows: T33S, R68W, Portions of Sections 24, 25 and 26. All sections are partially or fully <br />projected by New Elk Coal Company due to the unsurveyed nature of the Maxwell Land Grant. The above- <br />mentioned tracts of land are shown on the USGS 7.5 minute Quadrangle maps of Stonewall, Tercio and Vigil. <br />While impacts to fish and wildlife are not anticipated, underground mine subsidence could affected roads and <br />other facilities on the Bosque del Oso State Wildlife Area. Please find enclosed pertinent sections of the permit <br />revision dealing with subsidence and subsidence control. In order for us to comply with regulatory time frames, <br />we request that comments be submitted to the Division of Reclamation, Mining and Safety at the above s y - <br />5:00 p.m. on April 12, 2011. If no comments are received by this date, we will proc5pd-on-the assumption that <br />your agency has no concerns with or objections to the applicant's proposal. A copy of the entire revision <br />application is also available for public inspection at the Las Animas County Clerk and Recorder, 200 East First <br />Street, Room 104, Trinidad, CO 81082, and at the Division office.
