Hatcher <br />February 7, 2011 <br />Page 2 <br />Depletions <br />The anticipated total consumptive use for this plan is 52.8 acre-feet per year for up to 9.75 acres of <br />exposed water surface. Table 3 contains monthly values for consumptive use attributable to evaporation, <br />dust control, and water content of mined product. These monthly values add up to annual totals of 29.0 <br />acre-feet of evaporative loss, 6.2 acre-feet of water used for dust control, and 17.6 acre-feet of water lost <br />with 600,000 tons of mined product. <br />The IDS AWAS stream depletion model was used to determine the lagged depletions to the <br />South Platte River. The following parameters were used in the model: transmissivity (T), 150,000 <br />gallons per day per foot; specific yield (SY), 0.2; distance from the South Platte River to the edge of the <br />alluvium (W), 5,000 feet; and distance from the centroid of the exposed surface water areas to the <br />South Platte River (X), 3,300 feet. <br />Replacements <br />The source of replacement water is fully consumable water leased from Thornton. The leased <br />water from Thornton will be released from the Metropolitan Wastewater Treatment Plant ("Metro"). A 0.5% <br />per mile transit loss (14% overall loss for the 28 miles between Metro and the point of depletion) was <br />accounted for in the SWSP. The quantity of replacement water needed for this plan in 2011 is 55.3 acre- <br />feet. Thornton is the owner of the NCCI Pit #1 site and will continue to make replacement for depletions at <br />the NCCI Pit #1 site. <br />The lagged depletions include depletions resulting from past uses at the site, and the replacements <br />are shown on attached Table 4. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2011 through December 31, 2011, unless <br />otherwise revoked, modified, or superceded by decree. If this plan will not be made absolute by <br />a water court action by the plan's expiration date, a renewal request must be submitted to this <br />office with the statutory fee by November 15, 2011. <br />2. An application has been received for a new well permit (receipt no. 3648161) to replace permit <br />no. 67235-F for the gravel pit pond in accordance with §37-90-137(2) and (11), C.R.S. A new <br />permit is necessary for proper representation of the actual use and exposed pond surface area <br />under the current plan of operation. The provisions of §37-90-137(2) prohibit the issuance of a <br />permit for a well to be located within 600 feet of any existing well, unless the State Engineer finds <br />that circumstances so warrant after a hearing in accordance with the procedural rules in <br />2CCR402-5. The hearing will be waived if you are able to obtain statements from the owners of <br />all wells within 600 feet, verifying that they have no objection to your use of the proposed well. <br />Should a new well permit be denied for reasons of the 600 foot spacing, or any other legitimate <br />reason, approval of this amendment will be canceled.
