I E. of the N.M. PM
Water Division 4, Water District 28, Gunnison County
Dear loan:
The enclosed request for a substitute water supply plan pursuant to C.R.S. §37-90-137 for the
above referenced facilities has been amended as 'we discussed.. The revisions are to correct the names of
the ditches to be used for replacement, to remove the demand from November through March, and to
revise the currently exposed groundwater. The batch plant is served by a well permitted as 27134-F and
decreed in Case No. 79CW241. A more recent aerial of the site has been obtained, and the current
demand has been revised. The land dried up to meet the current demand has been changed to the north
side of Tomichi Creek. This was done so that irrigation on the south side of the creek will not be changed
until that water is needed The request is resubmitted in its entirety.
1 understand that the proposed amounts from each ditch to replace the maximum water use for the
mines are acceptable to the state. An affidavit will be provided to dedicate this water to the operation so
that DRMS's approach no. 4 can be implemented. Please let me know when to submit this affidavit.
Please let me know if there are any questions or comments. Thank you for your attention to this
request.
Sincerely,
Cheryl Signs, P. E.
Enclosure
cc: Pete Siegmund
Garrett Varra
