In order to avoid redundancy, the <br />necessary corrections are discussed in the Exhibit sections below. <br />So noted. <br />6.4.4 EXHIBIT D - Mining Plan <br />2) In response to item #9, the Division will extend the decision date to August 151h 2010 to give the applicant enough <br />time to obtain approval from the SEO for the Design Report for the proposed embankments. <br />The decision date is currently February 15, 2011. We have attached a Request to Extend the Decision Date to <br />February 28, 2011 in order to allow the maximum time for the SEO's approval prior to a potential MLRB hearing. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />3) In reference to your response to item 16 and 17 of the first adequacy review, please explain how the Operator <br />intends on excavating material from the overburden borrow areas and not lowering the grade in the topography? <br />Will there be enough material to backfill these areas to the original grade adjacent to the floodway? <br />We are not currently proposing to borrow material from within the floodway, however, if some borrowing occurs it <br />will be replaced to a maximum grade equal to the original grade (i.e. no obstruction of floodway flow capacity). <br />4) The response to item 17 references the Permanent Erosion Control Plan submitted in Attachment D. However, the <br />information submitted in this attachment are the designs for the proposed groundwater drain, and does not address <br />the erosion control structures. Your response indicates several types of erosion control structures will be used <br />along the edge of the floodway. Please submit an Erosion Control Plan indicating when the various types of <br />erosion control structures will be utilized, and the specifications of these structures. <br />Permanent erosion control is proposed for installation as the above grade fill portion of the reclamation is <br />completed (i.e. when Cell A is built all erosion measures adjacent to this will be constructed, etc.). The proposed <br />measures are shown in Exhibit E1. <br />5) The current approved reclamation plan calls for fertilizing the re-vegetation areas.
