Resolve Adverse Effects <br />• Avoid, minimize, or mitigate Adverse Effects <br />• Notify the Advisory Council on Historic Preservation (ACHP) of any Adverse <br />Effects <br />• Consult regarding resolving Adverse Effects with SHPO, Tribes, and other <br />Consulting Parties <br />• Involve the Public in efforts to resolve Adverse Effects <br />At this time, our office requests that the lead Federal agency initiate consultation with our office by <br />providing a scope of work, the proposed APE, and information on what work has been done to <br />identify consulting parties and historic properties thus far. We have enclosed a consultation <br />checklist for your review, which as applicable, as a guide for the documents and information we may <br />need to comment. We have also enclosed a flow chart that explains the coordination between <br />Section 106 and NEPA. Per 36 CFR 800.8, "Federal agencies are encouraged to coordinate <br />compliance with Section 106 and the procedures in this part with any steps taken to meet the <br />requirements of the National Environmental Policy Act." Also, Section 110 of the National <br />Historic Preservation Act states that Federal agencies should "coordinate with the earliest phases of <br />any environmental review carried out under the National Environmental Policy Act." <br />When you reach the identification step of the Section 106 consultation process, we recommend that <br />you review the documentation that our office and the BLM Little Snake Field Office have on file <br />regarding previous surveys and sites recorded within the APE. <br />We look forward to continued consultation on the subject project.
