TURNPIKE & DEEPE FARMS PIT <br />January 31, 2011 <br />Page 2 <br />In conclusion, DWR approves and acknowledges that the Turnpike and Deepe Farms Pits <br />are in compliance with the SEO's requirements pursuant to § 37-90-137(11) and therefore <br />meets approach number 4 as identified in the April 30, 2010 Division of Reclamation, <br />Mining and Safety letter. It should be noted that current guidelines no longer allows the <br />backfilling or lining of pre-1981 areas within a gravel pit to create an augmentation credit to <br />offset evaporative depletions from surface area exposed after December 31, 1980. Thus, <br />per your Exhibit D, the Turnpike Pit pre-1981 area is confined to the 3.04 acre and 0.47 <br />acre ponds at the location identified and the Deepe Farms Pit pre-1981 area is confined to <br />the 2.26 acre and 1.73 acre ponds at the location identified.
