MCC has added the following sentence to the second paragraph on page 2.05-169. "E-seam
longwall panel E6 may also be extended under Deep Creek Ditch in the Projected Potential
Mining Area (see Map 51)."
(c.) "Please either direct us to or add to the appropriate places in the permit application a
prediction of the worst possible consequences from subsidence and a monitoring plan
for the Deep Creek Ditch Flume (the ditch's elevated steel pipeline that crosses Deep
Creek and the concrete collection box at the pipeline outlet)."
MCC has added the Deep Creek Ditch flume to the first paragraph of page 2.05-109 and has
added following sentence to the end of the first paragraph on page 2.05-117. "One building and
a water diversion flume for the Deep Creek Ditch are located within the Dry Fork mining area."
MCC has already included potential consequences to Deep Creek Ditch on page 2.05-151 and
152, and has committed to monitoring and mitigation of any damage to the ditch , and other
renewable resource lands and structures, including the ditch flume.
10. "Please submit a full-sized copy of Map 51 showing the line for the 25-degree angle of draw
at its correct location around the perimeter of the Projected Potential Mining Area, using the
narrower line width for the 25-degree angle of draw that is shown on the existing approved
Map 51 in the permit application. The copy of Map 51 submitted on 1/14/11 shows the 25-
degree angle of draw line located approximately 220 feet too far northwest in the area near
Station 101, as calculated on the attached map. Also, please make any needed revisions on
the legend of Map 51 and in the permit application text to reflect any changes made on the
map."
In compliance with rules 2.05.6(6)(e)(F)(111) and (IV), Map 51 has been revised to depict the
maximum predicted 170 E-seam angle of draw (see Exhibit 60E) rather than the extremely over-
conservative 250 angle of draw that had previously been used for this map and the B-seam maps
as well. In addition, to reduce the enormity of the calculation and mapping project that would
have resulted by showing the "actual" varying 170 line around each projected mining area (i.e.
varying the line according to the actual overburden depth at each calculation point around each
panel, MCC used the maximum overburden depth estimated for each panel to show a worst case
predicted limit around the panel. Revised map 51 was e-mailed to you earlier today showing this
new line and the revised legend text. No changes were needed in the permit text as a result.
11. "We are researching your proposal to update Map 51 with each Annual Reclamation Report
and will let you know the conclusion."
For clarification, MCC proposes to submit a copy of its most recent, updated and approved Map 51
with each Annual Reclamation Report that includes the current "as-built" E-seam underground
workings (as of that point in time) on the approved map for information purposes only. MCC
does not believe that a revision application is warranted for this submittal unless a change in the
projected potential mining area is proposed.
Please contact me at (970) 929-2238 or by e-mail should you have questions regarding this submittal.
Sincerely,
Kathleen G. Welt,
Environmental Engineer III
cc: Doug Nolte - MCC
Dan Hernandez - CDRMS
