T. <br />11. The five stock tanks (PD 1, PD2, NTEP1, EP1 and EP2) constructed or planned for <br />construction in the Prospect watershed are part of the primary sediment control system. <br />Co 1 owyo has requested a waiver from quarterly inspections for these stock tanks pursuant <br />to Rule 4.05.9(18). However, since these stock tanks are a pa 1 t of the primary sediment <br />control system, they are not eligible for a waiver from quarterly inspections (Rule <br />4.305.9(18)(a)). Please add text to the narrative in the second paragraph on page <br />4.05-7 stating "The waiver does not include stock tanks PDI, PD2, NTEP1, EP1 or <br />EP2, constructed or planned for construction in the East Pit. These five stock tanks <br />are part of the primary sediment control system and, as such, are not eligible for the <br />waiver pursuant to Rule 4.05.9(18)(a)." <br />Colowyo's Response: <br />This text has been added to 4.05-7. <br />12. With Colowyo's 9 November 2010 responses for TR-87, permit page 4.05-2 was <br />updated. There is a problem with the pagination and text on this page, as it does not <br />logically flow with the pages before and after it. Based on the Divisions copy of the permit, <br />it appears as though this permit page may, in fact, be page 4.05-3. Please review the <br />pagination on page 4.05-3 and correct as necessary. <br />Colowyo's Response: <br />The pagination has been corrected and a new page has been submitted. <br />13. Colowyo has provided a new Appendix Exh7-14D - Section 16 Fill Ditch. There <br />appears to be a pagination problem with this appendix. The numbering starts on page Exh. <br />7-14D-1, continues to Exh. 7-14D-2 and Exh. 7-14D-3 then returns to Exh. 7-14D-2 (which <br />is different than the first page Exh. 7-140-2) and continues on after that, in order, from Exh. <br />7-14D-4 to the end of the section. Additionally, on page Exh 7-140-3 there is no actual text <br />or SEDCAD but a statement that says "Insert multiple pages from SEDCAD pdf files from <br />Exh 14..." This page is either in error or additional pages need to be added to this <br />appendix. Please check the pagination of Appendix Exh7-14D- Section 16 Fill Ditch <br />and correct as necessary. <br />Colowyo's Response: <br />As noted in the index sheet, this section is replaced in its entirety. All previous Exh. <br />7-14D materials are to be removed and replaced with the 9 new pages of the revised <br />text. We have provided a new page Exh. 7-14D-3 which shows "This page <br />intentionally left blank." <br />14. In the third paragraph on page 4.05-6 Colowyo provides text that identifies where the <br />five stock tanks can be located in the permit. The text states "The locations of these <br />impoundments are shown on Map 12 -Hydrology-South." These impoundments are also <br />shown on a very good figure on page Exh. 7-14R-8.
