At the July 12, 2010 Board meeting, the Operator was found in violation of C.R.S. 34-32.5-109 (1) for engaging in a
new operation without first obtaining a reclamation permit from the Board or Division. The Board ordered the
Operator to submit a Conversion Application by October 14, 2010 and to have the application in an approvable form by
February 10, 2011.
The Operator has submitted the required conversion application and the application is in the review process. On
January 24, 2011 the Division received a letter addressed to the Board from the Operator requesting a 60 day extension
to comply with the corrective actions. The Operator needs additional time to address the Division's adequacy review
of the application.
The Division does not object to the Operator's request. If the Board grants the Operator's request, the required
conversion application must be in an approvable from by April 11, 2011.
