Pineda <br />Director <br />Incomplete X" Hard Rock/Metal Mining <br />AM - 03, econd Notice of Incomplete <br />On January 11, 2011, the Division of Reclamation, Mining and Safety received your response to the November 29, 2010 <br />notice of incomplete application for the 112 :Hard Rock/Metal Mining Reclamation Permit Amendment Application <br />package for the Nahcolite Project, Permit No. M-1983-194. Staff review of the information received determined that the <br />following items must be received before the Division can consider your application as being submitted and technical <br />review can begin: <br />EXHIBIT A - Legal Description (Rule 6.4.1): The legal description must identify the affected land and be <br />wholly adequate for field location of the property. It can be in the form of metes and bounds survey or a <br />description by reference to township, range and section to at least the nearest quarter quarter section. Where <br />applicable, the street address or lot numbers may be used. The legal description referenced in Exhibit A <br />refers to the legal description that was stated in Exhibit A of Amendment 2 which describes the total area <br />contained within the four sodium leases is 8,358.14 acres. The application submitted for Amendment 3 <br />proposes a total acreage of 8,233 acres. Please submit an accurate legal description that meets the <br />requirements of Rule 6.4.1. <br />The response received December 29, 2010 addressing Exhibit A is not adequate. The legal description of the <br />sodium lease that was submitted under Technical Revision No. 30 cannot simply be cited and must be submitted <br />for Amendment No. 3 in order to make the application complete for technical review. Please submit an <br />accurate legal description that meets the requirements of Rule 6.4.1. <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): The current estimated reclamation cost only accounts for a <br />total disturbance of 62.52 acres. The proposed total affected acreage is 260 acres; please provide all information <br />necessary to calculate the costs of reclamation. The information must be submitted and broken down into the <br />various major phases of reclamation. You must provide sufficient information to calculate the cost of <br />reclamation that would be incurred by the state. <br />The response submitted states that "Calculating reclamation costs as development proceeds to be the <br />most accurate and efficient method of establishing reclamation costs." After reviewing the permit <br />revision list from May 2009 thru August 2010 the reclamation bond estimate has been recalculated a <br />total of four times. The purpose of the request for information to calculate the costs of reclamation is an <br />effort to gain information that will allow the Division to recalculate the reclamation bond every 3-4 years <br />rather than 3-4 times per year.
