Pineda <br />Director <br />On January 18, 2011 the Division of Reclamation, Mining, and Safety (Division) received a 112c quarry <br />application for the above referenced site from Montrose County. Per Rule 1.4.1(8) staff has evaluated <br />the application and found it to be complete for review within ten working days. <br />The decision date for a 112c application is ninety days (90) from the date of this letter per Rule 1.4.8(1). <br />Therefore the initial decision date is set for April 27, 2011. Please be advised that if all issues are <br />addressed after the public comment period is over a decision may be rendered earlier. If objections are <br />received the decision date could be push to a later date to accommodate any required Board hearing. <br />Montrose County must begin the public notice process in the local newspaper within ten (10) days of <br />the date of this letter per Rule 1.6.2(d). Please note that the example notice supplied in the application <br />has a commencement date of December 1, 2010 which has expired and should be corrected accordingly. <br />Per Rule 1.6.5 (1) the notice shall be published four (4) times, once a week for four consecutive weeks. <br />The comment period shall be twenty (20) days after the last date of publication per Rule 1.7.1(2)(a). <br />Staff recommends that Montrose County supply a copy of the notice to the Division upon first <br />publication for review and establishment of the date for final public comments. <br />Staff will be contact Buckhorn and Montrose County to conduct a pre-operational inspection in the next <br />30 days.
