On January 18, 2011 the Division of Reclamation, Mining, and Safety (Division) received a 112c quarry
application for the above referenced site from Montrose County. Per Rule 1.4.1(8) staff has evaluated
the application and found it to be complete for review within ten working days.
The decision date for a 112c application is ninety days (90) from the date of this letter per Rule 1.4.8(1).
Therefore the initial decision date is set for April 27, 2011. Please be advised that if all issues are
addressed after the public comment period is over a decision may be rendered earlier. If objections are
received the decision date could be push to a later date to accommodate any required Board hearing.
Montrose County must begin the public notice process in the local newspaper within ten (10) days of
the date of this letter per Rule 1.6.2(d). Please note that the example notice supplied in the application
has a commencement date of December 1, 2010 which has expired and should be corrected accordingly.
Per Rule 1.6.5 (1) the notice shall be published four (4) times, once a week for four consecutive weeks.
The comment period shall be twenty (20) days after the last date of publication per Rule 1.7.1(2)(a).
Staff recommends that Montrose County supply a copy of the notice to the Division upon first
publication for review and establishment of the date for final public comments.
Staff will be contact Buckhorn and Montrose County to conduct a pre-operational inspection in the next
30 days. An adequacy review will be done shortly thereafter.
