<br />Page 2 of 3 <br />TETRA TECH Ms. Karlyn Adams <br />January 24, 2011 <br />depletions resulting from pumping of these two wells will be replaced with consumable water <br />leased from the BWCD. <br />® Other: If storm water is not diverted or captured in priority, Colorado Water Law requires it to <br />be released, or replacement for evaporation will be required of the impounder/operator/owner of <br />the gravel pit. The State Engineer's current policy requires that all impounded water be released <br />to the stream system within a maximum of 72 hours after impoundment. Any exposed <br />groundwater must be backfilled immediately until a well permit issued pursuant to CRS 37-90- <br />137(2), allowing the exposure of groundwater in a pit, is obtained from the State Engineer. <br />While the Cerise Mine is operating, any stormwater that is captured will infiltrate the gravel <br />resource within 72 hours. Once the site is reclaimed, stormwater will be directed to an <br />infiltration basin to make sure any water captured will infiltrate and not be impounded for more <br />than 72 hours.
