The Division believes the currently approved seed mix will provide more diversity. <br />Is BLM in agreement with the approved seed mix? <br />f. 7.4 - Recommended Seeding for Reclamation, page 46 - More explanation is <br />needed from the CDOW as to the details of the final plant community that will <br />support suitable habitat for wildlife. Include a letter from the CDOW stating desired <br />species, shrub densities and planting arrangements as required in rule 4.15.8(7) and <br />4.18(5)(1). <br />2.04.11(2) <br />1. The Applicant met with the CDOW and DRMS on April 15, 2010 to determine what fish <br />and wildlife resources will be required. Please include the results of this meeting and <br />reference it in the text. <br />2.04.11(3) <br />The narrative incorrectly states that the Applicant has not received any guidance from the <br />DRMS regarding the level of detail and the areas for the wildlife studies. See 2.04.11(2) <br />above. <br />Rule 2.05.6 Mitigation of the Impacts of Mining Operations <br />2.05.6(2)(a)(i) <br />1. The Division received a letter from the CDOW dated January 6, 2011 (attached) outlining <br />discrepancies in the wildlife report. Please provide a response to each of the items outlined <br />in the letter. <br />2. The DOW letter dated July 16, 2010 referenced in this section is in the Fruita Loadout <br />permit file. Please include a copy of this letter in McClane PR-2 permit and reference <br />appropriately. Also include, in the McClane permit, the CDOW letter dated January 6, <br />2011 (attached, same as above) which is an updated follow-up to the July 6, 2010 letter. <br />3. It is not clear in the permit application whether the electric poles will have to be moved to <br />accommodate the coal waste pile. Please clarify. If they are being moved, include the <br />mitigation plan for the poles being used as raptor perches. <br />2.05.6(2)(a)(iii) <br />1. The Division requests that MCM commit to continual monitoring for threatened and <br />endangered species and report any new findings to the CDOW and CDRMS. <br />Other questions: <br />1. What is the reclamation plan for the existing sediment pond before it becomes the topsoil <br />storage area in PR-2? <br />6
