I . On January 7, 2011, Cotter filed with this Court a Complaint for Judicial Review, <br />Declaratory and Injunctive Relief against Defendants Mined Land Reclamation Board ("Board") <br />of the Colorado Department of Natural Resources and the Division of Reclamation, Mining & <br />Safety of the Colorado Department of Natural Resources. <br />2. The Complaint includes claims for relief pursuant to C.R.S. § 24-4-106, which <br />authorizes review of administrative agency determinations. <br />3. Pursuant to C.R.S. § 24-4-106(6), Cotter requests that the Court order Defendants <br />to submit to the Court a certified record of the following documents (whether in electronic or <br />paper format), concerning In The Matter of Cotter Corporation's Possible Violation, Cease and <br />Desist Order, Corrective Actions, and Civil Penalties for Failure to Comply with the Conditions <br />of an Order, Permit, or Regulation, File No. M-1977-300, Notice of Violation No. MV-2010- <br />030 and related proceedings: the original or certified copies of all pleadings, applications, <br />evidence, exhibits, and other papers presented to or considered by the Board, including but not <br />limited to the transcripts of the November 17, 2010 and November 18, 2010 hearing, all briefs, <br />other papers, and evidence presented by Cotter to, or otherwise considered by, the Board in <br />connection with the September 16, 2010 Notice of a Reason to Believe a Violation Exists at the <br />Schwartzwalder Mine, and the Board's Findings of Fact, Conclusions of Law, and Order, issued <br />December 8, 2010. <br />4. Pursuant to C.R.S. § 24-4-106(6), Cotter is prepared to advance to Defendants the <br />cost of preparing the record upon a statement of such cost by Defendants. <br />2
