Box 51314 <br />Colorado Springs, CO 80949 <br />Dear Mr. Astemborski: <br />During preparation of the NEPA Environmental Assessment, it has become evident that additional data will <br />need to be provided by Destiny Mining, LLC, in order for the BLM to adequately analyze any potential for <br />significant noise impacts sociated with hproposed mining operation. On November 12, 2010 a conference <br />call was held between BLM and representatives of Destiny Mining, LLC to preliminarily discuss potential noise <br />sources and mitigation, as well as the details outlined below. <br />It has been determined that a sustained 55 decibel limit for noise at the boundary of operations in closest <br />proximity to a residential dwelling is the criteria that will be used for assessing potential significant noise <br />impacts. This stipulation is a result of extensive review of many local regulations and policies, as well as <br />consideration of the established industry strategies for noise mitigation. <br />Please provide this office with a defensible approach for how the proposed mining operation will be able to meet <br />these noise criteria. At a minimum, elements provided should consist of an engineered concept of noise <br />emissions associated with mining and transportation activity, a comprehensive site plan for implementing noise <br />mitigation measures and methods that will be employed to ensure that the noise mitigation is being implemented <br />successfully.
