rThe Board accepted the soil replacement for our prime farmland and accepted the Substitute <br />subsoil as adequate replacement. This is against all rules and regulations and the Act governing <br />prime farmlands as well. The rules and regulations governing, prune farmlands again are being <br />taken out of conteD.. They read part of the rule and use it without reading the entire rules. First <br />off, any substitute soil must be equal to or better than what was in the natural existence. 4.25. <br />Also if a substitute soil was even considered, it had to be segregated separately and not <br />contaminated. This was never done. The "A' lift, the "B" lift and the "C" Iift would have to be <br />segregated. Also they keep stating that a minimum. of 48 inches must be saved and in PR -06, as <br />they reach that minimum, they think that is all they have to do. That is not what the rules and <br />regulations state. Again, taken out of context. They state that a 48 inch minimum because some <br />soils that have been classified as prime may not go as deep as 48 inches, they may go�td 40 or <br />even some a little less. So, the rules states that they must reach a 48 inch minimum or to the <br />natural soil which ever is less because of the soils that are less than 48 inches, the operator can <br />not be expected to get what wasn't there. But, if they would read the rest of the rule, it states for <br />those soils that are deeper, they must be replaced to thellu_anualitX, and depth that existed <br />in the natural existence. So, if they are 25 feet deep or 72 inches, or whatever, they are expected <br />to salvage and replace all of that and it specifically states that. And no Prime soils can be moved <br />from one place to another, so they roust return those to the depths that they were , where they <br />were. So, for the soils that was stolen off of our 51 acresttey need to find other Barx soils <br />elsewhere an rep ace %ose, ring our soi s ack, but, they cannot steal from our West side to <br />replace what they stole from our East SideIAgain the plan accepted by the Board is in violation <br />of the rules and regulations governing prune farmlands. The Board also would not allow me to <br />speak on anything. The gave me strict instructions that we were only allowed to discuss 4 or 5 <br />items and nothing more. Even during the lunch break, we were instructed by a Board lady to <br />only talk about the facts that we were told that we could speak on and nothing more. The rules <br />and regulations state that they must reply to all request for a formal hearing and they did not. We <br />were instructed by the pre - conference hearing office that ONLY ToEllen Turner and Michael <br />Morgan could attend the formal hearing of November 17'h and that another hearing would be <br />scheduled for the 35 other people who also had requested a_foggg hearing and that they would <br />be contacted and given another formal hearing date. Mr. And Mrs. Morgan was part of that <br />request, as we represented ourselves at this formal hearing of November 17'' as documented. <br />I was the ONLY person in the entire town of Nucla that was given a PUBLIC notice which was <br />sent by Fed X concerning the pre - conference hearing. No one else got this notice. Not Micael, <br />not Mr. Or Mrs. Morgan, not any of my witnesses, mot anyone, just me. This is another complete <br />violation. Also the Board had ordered discovery by all parties to be no later than closing time on <br />Wednesday and WFC waited until after that time to even mail their discovery and we did not <br />receive them until late the day after and we told the Board and they again ignored us and I have <br />all of the postmarked receipts to prove this. FAlso Western Fuels sent a letter to all of my <br />witnesses stating that I was a liar and that all of these three honorable teachers were fabricating <br />information right along with me and not to believe anything that I presented and that they too, <br />may have consequences, scaring them to deatg They allowed Western Fuels to submit this <br />entire packet to the pre - conference hearing officer with false documentation and also would not <br />.allow me to discuss anything that they had put in this packet_ Also, I was not made aware of this <br />pre- conference hearing or be able to prepare for it until just a little while before it began by <br />chasing down the FedX man to get the information.
