Rule 2.06.6(2)(a) states this survey will <br />be conducted using the standards established by the USDA, described in the National Soil Survey <br />Handbook. <br />13. <br />State Law / Regulation Potentially Violated: 4.25.5(2) <br />Description: The landowner has historically fertilized every year, PR -06 allows the operator to only <br />fertilize the 3rd, 5th and 7th years. We interpret this allegation to mean the fertilization plan is not <br />equivalent to the level of management employed before the land was mined. <br />
