Rule 3.1.11: mobile homes and other structures are covered by damage waivers <br />or owned by the land owner. No historic structures are identified within the <br />permit area. <br />Rule 3.1.12: Please clarify how the operator will mark the permit area and <br />the affected areas to ensure no disturbance occurs outside the affected lands. <br />Rule 3.1.13 Please confirm that will comply with the requirements for spill <br />reporting as outlined in this rule. <br />6.4.6 - Exhibit F, the Reclamation Map, Please note general issue outlined in 6.4.4 <br />above <br />6.4.7 - Exhibit G, Water Information, narration notes no groundwater, outside source for <br />consumptive use and less than 72 hour retention of stormwater captured. <br />6.4.8 - Exhibit H, Wildlife, Staff is somewhat perplexed by DOW letter of Dec. 9, 2010. <br />Neither DRMS nor the Mined Land Reclamation Board through staff is required <br />to submit a Mined Land Wildlife Statement by statute. DOW is notified through <br />the normal process as required and it is up to them to supply recommendations not <br />the other way around. As they did in 1980. Per the 1980 DOW documentation <br />and the December 2010 letter: <br />(a) the significant wildlife resources are noted, <br />(b) The seasonal use is noted, <br />(c) The non-existence of any threatened or endangered species is confirmed, <br />(d) A general description of the affects of mining activities on the local wildlife is <br />noted. <br />Per Rule 6.4.8 (2) DOW has been notified of the application and they must submit <br />any comments to the DRMS by the close of public comment with is noted as <br />February 23, 2011. Otherwise Exhibit H is considered adequate per the rule. <br />6.4.9 - Exhibit I, Soils is addressed. <br />6.4.10 - Exhibit J, Vegetation is addressed. <br />6.4.11 - Exhibit K, Climate is addressed. <br />6.4.12 - Exhibit L, Reclamation Costs is acceptable at this time. However, staff will <br />calculate an estimate after the adequacy review is completed. <br />6.4.13 - Exhibit M, Other Permits, three are noted. DRMS did get an inquiry from the <br />County and the operator is advised to get something in writing regarding <br />grandfathering or a need for a special permit.
