The note has been revised to include the term "Projected Potential Mining Area" and a footnote <br />added to clarify that this tern refers to the same area as the "Approximate Maximum Projected <br />Areal Extent of Potential Mineable E-seam" shown on Map 51. <br />4. "Please change "the coal lease and permit boundaries" on pages 1 and 2 of Exhibit 55B and <br />on page 1 of Exhibit 60E to "Projected Potential Mining Area"." <br />This change has been made as directed. See the revised pages attached. <br />5. "Please change "actual mineable coal limit or the lease and permit boundaries is reached <br />(whichever is first)" on page 1 of Exhibit 60E to "anywhere within the Projected Potential <br />Mining Area"." <br />The text has been revised to read "... additional mineable coal has been and may be found to <br />exist beyond the projected E-seam mining shown on permit Map 51. If mineable coal is found <br />beyond the projected mining and is within the Projected Potential Mining Area, MCC may <br />continue mining within this area." <br />6. "Please clearly state on page 1 of Exhibit 55B and page 1 Exhibit 60E that the subsidence <br />evaluation included the entire Projected Potential Mining Area as shown on Map 51 in the <br />permit application, if such a statement is accurate." <br />MCC has revised the text of the Exhibits to read "... the approximate maximum projected areal <br />extent of potential longwall mining (also referred to as the Projected Potential Mining Area shown <br />on MCC's permit Map 51 and shown as dashed lines on the east end of the of longwall panels ... <br />in Figure 1)." Map 51 has been corrected to better coincide with the longwall panels depicted in <br />Figure 1 of the Exhibit. <br />7. "Are the "expected" subsidence impacts to the Minnesota Creek Ditch Rider's cabin that are <br />described on page 46 of Exhibit 60E the same as the "worst possible consequences" for the <br />cabin that may be caused by subsidence? Rule 2.05.6(6)(b) requires a description of the <br />worst possible consequences. Is it possible that subsidence could hinder potential use of the <br />cabin?" <br />Page 2.05-•157 of the permit text has been revised as follows. <br />"Although no buildings are anticipated to be impacted by the projected E-seam mining in the Dry <br />Fork Lease area (see Map 51), the Ditch Rider's Cabin shown on Map 66 and included in the <br />inventory of structures on Table 42A, could be impacted by subsidence should planned mining of <br />longwall panel E6 be extended more than 3,000' and under the cabin location within the Projected <br />Potential Mining Area shown on Map 51. The worst possible consequence from subsidence to this <br />cabin is anticipated to be similar to that of the Dry Fork Cow Camp as described in Exhibit 60E. <br />Foundation cracks could occur, but the building is expected to remain intact and usable. Similar to <br />the Cow Camp, a survey of the cabin would be completed prior to longwall mining and again after <br />mining is complete in the area and as soon as access and ground conditions allow." <br />8. "Exhibit 60E suggests that a pre-mining survey of the Minnesota Ditch Rider's cabin be <br />conducted. Does MCC plan to conduct such a survey?" <br />See response #7, above. <br />9. "Please update the monitoring and repair plan for the Deep Creek Ditch in Section <br />2.05.6(6)(f)(iii)(B)(1-III) of the permit application to include the additional section of the ditch <br />that may be undermined in the Projected Potential Mining Area."
