AM-0-1- <br />Dear Mr. Joy: <br />The Division of Reclamation, Mining and Safety has begun the review process for the above referenced 112c <br />permit application. The project appears to be a straight forward request for an amendment to the existing 112c <br />Construction Materials Reclamation Permit. A review of the application has revealed a few clarifications and <br />issues that need to be addressed. <br />1) In Exhibit D, page 19, it is stated that "To ensure that water from inside the operation does not leave the <br />site, an existing sediment pond is located below the mining area. Any additional water will be channeled <br />into a small, dry draw along the northwest corner of the pit. " What, if any, discharge permit is held by the <br />applicant? If a discharge permit is not held by the applicant please consult the Colorado Department of <br />Public Health and Environment to determine if a discharge permit is required prior to discharging into a <br />drainage that leads offsite. Also, please describe the frequency of use and amount of water that is proposed <br />to be discharged into the drainage. The drainage is not identified on the mine plan or reclamation plan <br />maps. Please submit revised mining and reclamation plan maps that clearly identify the drainage and <br />conveyance path. <br />2) The proposed final reclamation slope steepness is 2H:1 V. Please provide information that justifies slopes <br />steeper than 3H:1 V for the proposed post mine land use of rangeland. <br />This is a preliminary review. Other issues may arise from other agency comments, and as more information is <br />supplied. This application cannot be approved until the issues brought forth are adequately addressed. Please <br />submit a response to the issues as soon as possible, but no later than March 7, 2011 so the decision due date set <br />for March 21, 2011 can be met.
