8.0 Discussion of Reclamation Areas and Current Status <br />Exhibit 22 -1 shows all disturbed and reclaimed areas for the New Horizon 1 site. <br />8.1 Permit Area 1 <br />Permit Area 1 is 101.79 acres in size and has 51.9 acres of disturbed area. The area was <br />reclaimed in 1978 -1990 using Seedmix 1. Only 6 inches of soil was available for <br />reclamation. Slopes are from 0 -10 %. This disturbed area is called Vegetation Sampling <br />Area A -1. The post- mining land use of this area is rangeland. This area was disturbed <br />pre -law and falls under Regulation 4.15.10. This area achieved a 900% bond release (all <br />phases) in 2009. <br />8.2 Permit Area 2 <br />Permit Area 2 is 103.57 acres in size and has 77.0 acres of disturbed area plus two small <br />pond areas (Ponds 1 and 6) which total no more than 4.6 acres. The pond areas contain <br />cattails and generally contain water, therefore, they will not be part of the vegetation <br />study area for bond release. The disturbed area of 77.0 acres is therefore designated as <br />Vegetation Sampling Area 1 -B. Permit area 2 area was reclaimed in 1978 -1990 using <br />Seedmix 1. Less than 6 inches of soil was available for reclamation. Slopes are from 0- <br />10%. Since this area was planted during the same time frame as Permit Area 1 and had <br />the same seed mix, with identical slopes and elevations, these two areas will be <br />considered as one vegetation sampling unit (LMU). The post- mining land use of this area <br />is rangeland. This area was disturbed pre -law and falls under Regulation 4.15.10. This <br />area achieved a 900% bond release (all phases) in 2009. <br />8.3 Permit Area 3 <br />Permit Area 3 is 94.59 acres in size and has 67.9 acres of disturbed area restored to <br />dryand pasture and 6.39 acres restored to irrigated hayland at the request of the Garvey <br />family, who own the property. The 67.9 acre area is divided into one area 10.34 acres <br />and another of 57.61 acres. Both areas were disturbed by Peabody Coal post -law. <br />Peabody did initial reclamation of the 10.34 acre area and the 57.61 acre area in <br />1991 -1992 using seed mix 5. WFC disced & reseeded the 57.61 acre area in 1993 with <br />seed mix 5 due to poor growth. After poor growth in 1994, WFC reseeded and irrigated <br />the 57.61 acre area in 1995 using seed mix 5. The area was also irrigated in 1996. No <br />additional work was ever done on the 10.34 acre area after its initial seeding. Soil of 10- <br />15" depth was available for reclamation. Slopes are from 0 -6 %. This disturbed area is <br />called Vegetation Sampling Area 2 and will be sampled separately. This area was <br />reclaimed under Regulation 4.15.8. The reclaimed irrigated hayland is called Vegetation <br />Sampling Area 3 and will have separate standards for irrigated hay. <br />As of the Mid Term Review of 2006, this area has attained full phase 9 and 2 bond <br />release. <br />REVISED 11 Nov 09 Tab 22 -15 <br />
