Permit No. C-1981- <br />019 <br />Dear Mr. Stark, <br />Colowyo has received the Division's preliminary adequacy comments on SL-05 and <br />has the following comments and responses: <br />Division's Comment <br />The data from the BRB 96-99 sampling includes data from reclamation blocks <br />not included in the phase 111 bond release block for both 2008 and 2009. These <br />reclamation blocks include WP003 and WP004. In order for the Division to <br />consider the data for BRB 96-99, sampled in 2008 and 2009, as having achieved <br />reclamation success, the data collected from these two reclamation blocks <br />(WP003 and WP004) will need to be removed from the data set. Data collected <br />from transects 4, 5, 6, 7 and 8 from the 2008 sampling year fell within <br />reclamation blocks not under consideration for Phase 111 Bond Release. Data <br />collected from transects 34, 35, 37 and 38 from the 2009 sampling year fell <br />within reclamation blocks not included in the Phase 111 Bond Release block. <br />Based on Map 2 from the 2009 vegetation report, it is unclear whether transect <br />36 fell within a reclamation block included in the Phase 111 Bond Release block. <br />Please remove the transect data that do not fall within the Phase 111 Bond <br />Release block limits for BRB 96-99. Please recalculate and resubmit the <br />resulting vegetation sampling data for reclamation block BRB 96-99 to the <br />Division for review. <br />Colowyo's Response: <br />The vegetation study reports have been recalculated as a result of the Division's <br />comment. These reports are included with this submittal for the Division's review.
