Stipulation #19 <br />Kerr Coal Company has submitted detailed bonding liability cost estimates in response to the <br />Division's preliminary determination. The Division is reviewing bond liability estimates <br />submitted by Kerr Coal Company. The Division, in conjunction with Kerr Coal Company, is to <br />make a determination of cost estimates to be used in estimating the total bond amount. Total <br />bond for the mine site (151 increments) is set at $4,290,800.00 and Kerr Coal Company is to <br />maintain a bond in that amount in full force and effect no later than 60 days after issue of the <br />Division's decision on permit renewal. The Division will determine additional amounts which <br />may be required, if any, for the Marr site. <br />Status: Terminated 2-25-1993. <br />Stipulation #20 <br />Kerr Coal Company will continue to work with the Division to establish the reclamation liability <br />amount. When an amount is agreed upon, this amount will be submitted as a new bond or rider to <br />the existing bond pursuant to Rule 3.02. <br />Status: Terminated 5-14-1996. <br />Stipulation #21 <br />Within 30 days of approval of MR25, Kerr Coal Company will submit text page 816-175R, <br />clarifying that map 29 depicts the loadout haul roads only and that haul roads A and 8 were <br />modified via MR-25 to permanent light use roads, as depicted on map 28A - Mine Area Existing <br />Structures. Map 28A should be clearly labeled to show that both previous haul road segments are <br />now permanent light-use roads. The revision number should be included at the bottom of the text <br />pages. Text should be added discussing reclamation sequence. <br />Status: Complied With 11-28-1995. <br />Stipulation #22 <br />The operator is required to provide a complete inventory of all wells within the permit boundary <br />including the following: (A) well log and completion information, including borehole diameter, <br />casing type, well depth, gravel pack and grout intervals; (8) ground conditions including access <br />to wells; (C) water level measurements; (D) depth of each well, condition of borehole/casing and <br />amount of sediment in each well; and (E) a summary of how and when each well will be sealed. <br />Status: Terminated 1-30-2002. <br />Stipulation #23 <br />The operator is required to submit a plan for the abandonment of all wells located on BLM <br />property no later than January 25, 2002. This plan needs to address the proper abandonment and <br />sealing of all wells and a timetable so that all wells are abandoned and reclaimed by 31 May <br />2002. <br />Status: Complied With 1-31-2003. <br />5
