NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Permit Renewal <br />Application No. 6 (RN-6), submitted by Kerr Coal Company for a coal mining permit at the Marr Mine <br />(Permit No. C-1980-006). The proposed renewal will allow for continued reclamation at the site. <br />The Marr Mine is located in Jackson County, approximately 12 miles east of Walden, Colorado, <br />Colorado. Coal interest at this Surface mine is Federal, state and private, and the surface to be affected is <br />Federal, state and private land. The permit area encompasses approximately 1,645.00 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101 et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />A copy of the "Proposed Decision and Findings of Compliance", including any stipulations, is on file for <br />public inspection at the Colorado Division of Reclamation, Mining and Safety, Room 215 Centennial <br />Building, 1313 Sherman Street, Denver, Colorado 80203, Northwest Colorado Consultants, Inc., 2580 <br />Copper Ridge Drive, Steamboat Springs, CO 80487, and at the Jackson County Clerk's Office, 404 4th, <br />Walden, CO 80480. Persons with an interest that may be adversely affected by the proposed decision <br />may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such <br />request must be made within thirty (30) days of the initial publication of this notice, must be in writing, <br />and must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision.
