ISSUED BY REGION 8 <br />INTRODUCTION <br />Pursuant to 40 C.F.R. § 124.19(a), James B. Woodward ("Petitioner") respectfully petitions <br />for review of the conditions of UIC Class V Permit No. C051237-08412 ("the Permit"), which <br />was issued to Powertech (USA) Inc. ("Permittee) on December 3, 2010 by Environmental <br />Protection Agency Region 8 (`EPA"). The permit at issue in this proceeding authorizes <br />Permittee to reinject groundwater from an aquifer pump test at the proposed Centennial uranium <br />site in Weld County, Colorado. Petitioner contends that certain permit conditions are based on <br />clearly erroneous findings of fact and conclusions of law or an exercise of discretion, or an <br />important policy consideration which the Environmental Appeals Board (`Board") should <br />review. Specifically, Petitioner challenges the following permit conditions: <br />(1) Permit condition E.1. allowing the Region 8 UIC Program Director ("Director") to add <br />"additional monitoring requirements" upon notice from the Permittee of "any <br />modification in injection procedures that might result in the potential for the injectate to <br />move outside the A2 sandstone." <br /> <br />1
