' <br />Contact: Bud Bower - (970) 824-2793 <br />Section 3, Twp 6 North, Rng 90 West, 6th P.M., Moffat County <br />CONDITIONS FOR APPROVAL <br />James H &Kathleen H Ross requested partial acreage release request for the Ross Pit, Permit <br />no. M-1990-134. <br />The Ross Pit operates under well permit no. 37997-F. The permit was issued on November <br />21, 1990 for the operation of a well (gravel pit) exposing and diverting ground water tributary to <br />the Yampa River at a point where unappropiriated water is available for withdrawal. The uses <br />of permit no. 37997-F are limited to evaporation and losses by removal of aggregate product <br />during mining operations and recreational purposes including fish propagation and wildlife <br />habitat upon completion of gravel mining operations. The average annual amount of ground <br />water to be appropriated shall not exceed 46 acre-feet with the total surface are of the <br />proposed ground water pond limited to 13 acres. A cross section drawing showing the extent <br />of the excavation, maximum depth, static water level and the date the ground water was <br />exposed was submitted to the,SEO on January 10, 2011 indicating that the pit was excavated <br />in July 1990. This permit is valid per § 37-90-137(2) and (11), C.R.S. <br />Per a conversation with Bud Bower on January 6, 2011, portions of the area in the acreage <br />release request are submerged as was proposed in the mine reclamation plan and as <br />permitted under 37997-F for recreational purposes upon completion of gravel mining <br />operations.
