Pirleda <br />Director <br />Greenwood Village, CO 80111 <br />RE: Filing of an Application to Convgrf a 110(2) Operation to a 112d-1 Operation (CN-01), <br />May Day Idaho Mine Complex, Permit File No. M-1981-185.• <br />Dear Mr. Robinson: <br />On January 10, 2011, the Division of Reclamation, Mining and Safety (Division or Office) <br />determined the above referenced application to be complete for the purposes of filing. All <br />comment and review periods began on January 10, 2011. The decision date for your <br />application is scheduled for April 10, 2011. <br />Pursuant to Hard Rock/Metal Mining Rule 1.6.2(1)(d), within ten days of filing you must publish <br />notice in a newspaper of general circulation in the locality of the proposed mining operation <br />once a week for four consecutive weeks. Pursuant to Rule 1.6.2(1)(e), immediately after the <br />first publication, mail a copy of the notice to all owners of record of surface and mineral rights, <br />holders of any recorded easements, and all owners of record of lands that are within 200 feet <br />of the boundary of affected land. Pursuant to Rule 1.6.5(2), within ten working days, after the <br />last publication or as soon thereafter as proof has been obtained, the Applicant shall mail proof <br />of the newspaper publication, required under Rule 1.6.2(1)(d), to the Office. Proof of notice <br />and mailings, such as Certified Mail, Return Receipt Requested, must be submitted to the <br />Division prior to the decision date. Additionally, any changes or additions to the application on <br />file in our office must also be reflected in the public review copy, which has been placed with <br />the La Plata County Clerk and Recorder. <br />The Division is reviewing your application to determine whether it is adequate to meet the <br />requirements of the Act. We will contact you if additional information is needed. <br />Please be reminded that all Operators must contact the Colorado Department of Public Health <br />and Environment, Water Quality Control Division, regarding storm water permits. <br />S <br />a(E <br />Wallace H.
