This is a record of administrative action. No site visit was conducted today. As a result of Ms. <br />JoEllen Turner's citizen complaints dated January 6 and January 11, 2011 I am issuing Ten Day <br />Notice (TDN) #X 11-140-182-001. <br />Ms. Turner alleges in her complaint dated January 6, 2011 that her prime farmland topsoil was <br />being stripped in the rain and under snow. I interpret this complaint as alleging topsoil salvage <br />operations were conducted on PFL during periods of excessive precipitation and that the soil was <br />saturated. If the soil was saturated, handling it could have damaged its physical and chemical <br />properties and operations would not have minimized erosion, contamination and / or compaction. <br />This is a potential violation of Colorado Rules 4.06.2 and 4.06.3 (topsoil removal and storage <br />regulations). <br />Ms. Turner alleges in her complaint dated January 11, 2011 that rocks were not removed prior to <br />replacing topsoil. I am interpreting this as a potential violation of Rule 2.05.4(2)(d) and permit <br />conditions identified at 2.05.4(2)(d) subsection 13.1. <br />3 0? /{
