Radabaugh: 303-526-2600 Dear Ms. Radabaugh: We have reviewed your letter dated November 22, 2010, requesting approval of a Substitute Water Supply Plan ("SWSP") on behalf of Loveland Ready Mix Concrete, Inc. ("Loveland Ready Mix" or "Applicant") to cover depletions caused by an existing gravel mining operation. The required fee of $257 for the renewal of this SWSP has been received (receipt no. 3648107). The original plan was approved on August 7, 2003 and was most recently renewed in a letter dated December 23, 2008. SWSP Operations The Green/Croissant Pit (WDID 0403010) consists of approximately 212 acres located in Section 30, Township 5 North, Range 67 West of the 6t' P.M. in Weld County and is comprised of four (4) mined cells. According to your letter, mining is complete in Cells 1, 2, and 3. Mining in Cell 4 is anticipated to begin in the summer of 2011 and continue through at least 2012. Mining is likely to occur at this site for another 10 to 15 years, depending on market conditions. During 2011 and 2012, there will be evaporative losses from mined cells, a dewatering trench, settling ponds, and wash ponds. Operational losses will include water retained in aggregate removed from the site, water used in concrete batching, and water used for dust suppression. A water court application for a permanent augmentation plan for the Green/Croissant Pit was filed by Loveland Ready Mix on July 31, 2009 under case no. 09CW105. This case is currently scheduled for trial November 14-17, 2011. The approval of this plan does not imply a position by our office on any litigation associated with case no. 09CW105 or any other case.
