PiAeda <br />Director <br />Re: Agreement to Mine Material Along Common Boundary of Gravel Pits, Montoya Pit (M-1980-146) and <br />Crader Pit (M-1981-114); Agreement Approved by the Division. <br />Dear Mssrs. Gilleland and Davis, <br />Thank you for the letter of agreement you submitted to our office, which you both signed on December 14, 2010. In <br />it you jointly and mutually agree to coordinate your mining and reclamation activities of that portion of the two <br />respective permitted gravel pits named above,,that portion being located along the common boundary line of both <br />permits. This agreement was submitted to bolster your request to this office to allow a slight modification of the <br />mining and reclamation plans for the two permits. The modification would be to allow encroachment of mining in <br />each pit, up to that common boundary, eventually eliminating any ridge of unmined material between the two pit <br />floors. <br />Recognizing that differing operations in the two pits might contribute to some instability or conflicting timeframes <br />for reclamation, etc., was important. However, your agreement includes commitment to coordinate your efforts at <br />providing slope stability, topsoil protection, drainage control, and ultimately, final reclamation within your respective <br />permitted areas. All this stated as to be done toward providing a better beneficial post-mining land use. <br />This office agrees that removing an unmined ridge between adjoining gravel pits can enhance reclamation, but it is <br />not always possible, and should not be attempted without some form of agreement. The Division in this case <br />appreciates the discussion and agreement between C&J Gravel and La Plata County.. From the Division's <br />perspective, this agreement does not bind either party to the mining and removal of the ridge, does not constitute a <br />technical revision of either permit, and any degree of the mining of the ridge under this agreement is consistent with <br />the existing mining and reclamation plans in the permits. The proposed plan under this agreement does not change <br />the reclamation bond amount of the Montoya Pit. <br />This agreement is supported and approved by the Division, since all other existing requirements of the mining and <br />reclamation plans remain the same and in effect.
