6. This item is resolved. Colowyo has provided the necessary commitment to have each
new ditch segment certified by a registered, professional engineer and provide that
certification in the following year's Annual Reclamation Report. The commitment is on
permit page 4.05.2 and Exhibit 7-14-4.
Rule 4.05.9 - Impoundments
7. This item is resolved. Colowyo has corrected the stock tank names and years of
construction as requested.
8. This item is resolved. Colowyo has provided the 25-year, 24-hour storm event modeling
for the 2017 worst case hydrologic condition showing that the event can be safely passed
through the Prospect Pond spillway system.
9. This item is resolved. The Division agrees that Colowyo can retain the old stock tank
design in Figure 2.05-6 for historical purposes.
The following are new adequacy questions based on the updated materials provided by Colowyo
in their 8 November 2010 responses.
10. On the 7 November 2010 "Change Sheet for Permit Revisions, Technical Revisions and
Minor Revisions", page 2, Colowyo shows that Pages 7-14H-1 through 53 should be
deleted and replaced only with page 7-14H-1. Colowyo is proposing to delete Appendix
Exh7-14H - Generalized Ditch Design Procedures, Permanent Channels, July 2006 in
its entirety and replace it with only a cover page denoting the appendix removal. While
Colowyo does provide new Exhibit 7, Item 14, Part R - East Pit Reclamation Sequencing
and Ditch Designs for Prospect Ditch, North Tributary East Pit Ditch and Final East Pit
Ditch, the removal of Appendix Exh7-14H removes all of the generalized ditch
designs that were used to design the permanent post-mining drainage channels in
the West Pit. Colowyo must retain Appendix Exh7-14H, as it is still required
for, at a minimum, the Taylor Tributary Ditch, the Taylor Ditch, the East
Taylor Ditch and the West Pit Ditch. Please update the Change Sheet to
reflect inclusion of this portion of Exhibit 7.
11. The five stock tanks (PD1, PD2, NTEP1, EP1 and EP2) constructed or planned for
construction in the Prospect watershed are part of the primary sediment control system.
Colowyo has requested a waiver from quarterly inspections for these stock tanks pursuant
to Rule 4.05.9(18). However, since these stock tanks are a part of the primary sediment
control system, they are not eligible for a waiver from quarterly inspections (Rule
4.305.9(18)(a)). Please add text to the narrative in the second paragraph on page
4.05-7 stating "The waiver does not include stock tanks PD1, PD2, NTEP1, EPI or
EP2, constructed or planned for construction in the East Pit. These five stock tanks
are part of the primary sediment control system and, as such, are not eligible for the
waiver pursuant to Rule 4.05.9(18)(a)."
12. With Colowyo's 9 November 2010 responses for TR-87, permit page 4.05-2 was
updated. There is a problem with the pagination and text on this page, as it does not
logically flow with the pages before and after it. Based on the Divisions copy of the
permit, it appears as though this permit page may, in fact, be page 4.05-3. Please review
the pagination on page 4.05-3 and correct as necessary.
