6. This item is resolved. Colowyo has provided the necessary commitment to have each <br />new ditch segment certified by a registered, professional engineer and provide that <br />certification in the following year's Annual Reclamation Report. The commitment is on <br />permit page 4.05.2 and Exhibit 7-14-4. <br />Rule 4.05.9 - Impoundments <br />7. This item is resolved. Colowyo has corrected the stock tank names and years of <br />construction as requested. <br />8. This item is resolved. Colowyo has provided the 25-year, 24-hour storm event modeling <br />for the 2017 worst case hydrologic condition showing that the event can be safely passed <br />through the Prospect Pond spillway system. <br />9. This item is resolved. The Division agrees that Colowyo can retain the old stock tank <br />design in Figure 2.05-6 for historical purposes. <br />The following are new adequacy questions based on the updated materials provided by Colowyo <br />in their 8 November 2010 responses. <br />10. On the 7 November 2010 "Change Sheet for Permit Revisions, Technical Revisions and <br />Minor Revisions", page 2, Colowyo shows that Pages 7-14H-1 through 53 should be <br />deleted and replaced only with page 7-14H-1. Colowyo is proposing to delete Appendix <br />Exh7-14H - Generalized Ditch Design Procedures, Permanent Channels, July 2006 in <br />its entirety and replace it with only a cover page denoting the appendix removal. While <br />Colowyo does provide new Exhibit 7, Item 14, Part R - East Pit Reclamation Sequencing <br />and Ditch Designs for Prospect Ditch, North Tributary East Pit Ditch and Final East Pit <br />Ditch, the removal of Appendix Exh7-14H removes all of the generalized ditch <br />designs that were used to design the permanent post-mining drainage channels in <br />the West Pit. Colowyo must retain Appendix Exh7-14H, as it is still required <br />for, at a minimum, the Taylor Tributary Ditch, the Taylor Ditch, the East <br />Taylor Ditch and the West Pit Ditch. Please update the Change Sheet to <br />reflect inclusion of this portion of Exhibit 7. <br />11. The five stock tanks (PD1, PD2, NTEP1, EP1 and EP2) constructed or planned for <br />construction in the Prospect watershed are part of the primary sediment control system. <br />Colowyo has requested a waiver from quarterly inspections for these stock tanks pursuant <br />to Rule 4.05.9(18). However, since these stock tanks are a part of the primary sediment <br />control system, they are not eligible for a waiver from quarterly inspections (Rule <br />4.305.9(18)(a)). Please add text to the narrative in the second paragraph on page <br />4.05-7 stating "The waiver does not include stock tanks PD1, PD2, NTEP1, EPI or <br />EP2, constructed or planned for construction in the East Pit. These five stock tanks <br />are part of the primary sediment control system and, as such, are not eligible for the <br />waiver pursuant to Rule 4.05.9(18)(a)." <br />12. With Colowyo's 9 November 2010 responses for TR-87, permit page 4.05-2 was <br />updated. There is a problem with the pagination and text on this page, as it does not <br />logically flow with the pages before and after it. Based on the Divisions copy of the <br />permit, it appears as though this permit page may, in fact, be page 4.05-3. Please review <br />the pagination on page 4.05-3 and correct as necessary.
