Mr. Allen Sorenson - Page Two <br />June 18, 2010 <br />As a result of the above-noted pre-existing conditions and on behalf of AGC, I have already <br />established contact with DRMS and the CDPHE Water Quality Control Division, and will be <br />similarly contacting Boulder County and other agencies as appropriate in this regard (although it <br />is my understanding that Mr. Mark Williams, Water Quality Program Coordinator personally <br />observed these site conditions on June 16, 2010 in response to two citizen's complaints). <br />The purpose and intent of initiating immediate contact with each agency or entity is to: first, <br />establish agency awareness and support for AGC's commitment to timely implement corrective <br />action with respect to the two outstanding water management issues; and second, ensure that <br />future operations fully conform to applicable rules, county ordinances, state, and federal law. <br />Any corrective_tion to be undertaken with respect to the two outstanding water management <br />issues will involve a number of cross-agency authorities. The complexities are somewhat <br />compounded by inherited (pre-existing) deficiencies in, and/or the complete lack of, required site <br />operating permits. Regardless, AGC, through immediate and direct interaction with the <br />representatives from DRMS, CDPHE WQCD, Boulder County, and other agencies as <br />appropriate, intends to identify and address requirements associated with timely implementation <br />of an interim corrective action program, and while doing so, make significant progress toward or <br />fully achieve the requisite permit status for each respective permitting authority. <br />In order to accomplish this, I anticipate discussing available alternatives within each agency's <br />purview in order to rapidly develop a mutually acceptable Corrective Action Plan which, upon <br />approval by DRMS and issuance of required permits, would result in AGC implementation under <br />the DRMS permitting authority and oversight. <br />I anticipate development and delivery of a Corrective Action Plan shortly after I have established <br />meaningful dialogue with all agencies involved.
