40. On page 22 of Section 2.04.7, it is stated that sediment pond NHN-001 is designed to receive <br />pumped pit water and backfill seepage water. Please point out where pumped pit water and <br />backfill seepage water are accounted for in the hydrology designs for pond NHN-001. <br />41. It does not appear that subwatershed SW-3C is shown on Map 2.05.3(3)-1. Please revise Map <br />2.05.3(3)-1 accordingly. <br />42. On Map 2.05.3(3)-1, the subwatershed for the topsoil stockpile area is mislabeled as SW1-A. <br />Please revise Map 2.05.3(3)-1 so that the label reads SW-TS. <br />43. On page 6 of Section 2.05.6(3), Protection of the Hydrologic Balance, it is stated that excessive <br />leakage from the sediment ponds will be avoided by compaction of the pond bottoms and sides. <br />Please explain what "excessive" is and why the ponds should not be lined. <br />44. In the second paragraph on page 9 of Section 2.05.6(3), it is stated that water augmentation <br />during the irrigation off season will not be required. However, it is stated elsewhere in the <br />permit text that off season water is diverted into the irrigation system to fill cisterns etc. Please <br />explain why water augmentation would not be needed during the irrigation off season. <br />45. As required by Rule 4.05.9(3) and because the sediment pond embankments are in excess of 10 <br />feet in vertical height, please ensure that the ponds are also designed and constructed in <br />accordance with C.R.S. 37-87-105. <br />46.
