C /98v o 0 7
I -A ?/Z3
Kaldenbach, Tom GIs?S CasK
From: Daniel E Gray [degray@fs.fed.us]
Sent: Thursday, December 23, 2010 3:11 PM
To: Kaldenbach, Tom; Ryan Z Taylor
Subject: RE: TR123
Attachments: tr123_bioreview.pdf
Tom: I will have to send you two pdf maps so that there will be sufficient detail and you can make sense out of them.
This first map is of the revised access to the E3-44 and E3-47 mdw pads. They are referred to as the 45 and 48.5 pads
respectively. There is a Cooper's hawk nest shown on the map just a bit to the north. It is only about 500 feet or so from
the proposed development and would have had the same timing restrictions (if the nest is active) even without the
revision. Lease COC-1362 has a 1/4 mile buffer for active raptor nests so this nest is well within that 1/4 mile buffer. This
nest was not active in 2010 but John Monarch informed me that it was the previous year (2009). John will survey this
location again in May and the hawks will be setting up a nest territory if they are using the location for the year and he will
be able to inform the mine whether or not they can start construction or will have to wait until after August 15. The next
map I will send will detail the access to the E3-15 pad on the west end of the E3 panel. Let me know if you have any
questions.
Thanks
Dan
"Kaldenbach, Tom" <Tom.Ka1denbach0state.co.us>
12/23/2010 02:29 PM
Thank you Dan. There was only a small portion of the activity that
had not been covered by previous archaeological surveys and I inspected the ground and communicated to her that there
were no heritage resource concerns (I am a certified para-archaeologist). She has already written a letter to the State
Historic Preservation Office describing the revision and that no heritage resource concerns were identified and she is
waiting for a concurrence letter back from the state indicating that the project can proceed.
1
