November 29, 2010 <br />Bob Warneke <br />Natural Soda, Inc. <br />3200 CR 31 <br />Rifle, CO 81650 <br />Re: Nahcolite Pro'ect, Permit No. M-1983-194, Receipt of <br />Incomplete 112 Hard Kock/Metal Mining Reclamation Permit <br />Amendment Application Package, AM - 03 <br />Dear Mr. Warneke: <br />On November 29, 2010, the Division of Reclamation, Mining and Safety received your <br />112 Hard Rock/Metal Mining Reclamation Permit Amendment Application package for <br />the Nahcolite Project, Permit No. M-1983-194. Preliminary review of the information <br />received determined that the following items must be received before the Division can <br />consider your application as being submitted and technical review can begin: <br />EXHIBIT A - Legal Description (Rule 6.4.1): The legal description must identify the <br />affected land and be wholly adequate for field location of the property. It can be in <br />the form of metes and bounds survey or a description by reference to township, <br />range and section to at least the nearest quarter quarter section. Where <br />applicable, the street address or lot numbers may be used. The legal description <br />referenced in Exhibit A refers to the legal description that was stated in Exhibit A of <br />Amendment 2 which describes the total area contained within the four sodium <br />leases is 8,358.14 acres. The application submitted for Amendment 3 proposes a <br />total acreage of 8,233 acres. Please submit an accurate legal description that <br />meets the requirements of Rule 6.4.1. The application submitted for Amendment 3 <br />proposes a total permitted acreage of 8,223 acres. The legal description was <br />submitted in NSI's 2010 Mine Plan, Section 2.3 and is the legal description <br />contained in NSI's current Sodium Leases, as issued by the BLM. This legal <br />description describes 8,223 acres, more or less. The legal description found in <br />amendment 02 (1991) was consistent with the Sodium Leases, issued by the BLM, <br />which were current at that time and described 8,358.14 acres, more or less. It has <br />been our experience that most, if not all, surveyed legal, land descriptions contain <br />the verbiage "more or less" when referring to calculated acreages. There exists a <br />1.6 percent difference between the two stated acreages. We dislike discrepancies <br />as much as the DRMS but understand that they have existed and will undoubtedly <br />continue to exist into the future. The point to be made was that the DRMS has <br />recognized and approved NSI legal descriptions of 8,000 plus acres.
