Ross Pit, Permit No. M-1990-134, Response to Concerns and Requests <br />Dear Mrs. Hall: <br />Thank you for taking the time to share your concerns with the Division of Reclamation, Mining and <br />Safety (Division) regarding the above referenced sand and gravel operation. The Division is responsible <br />for overseeing mining and reclamation activities, serving as staff to the Mined Land Reclamation Board <br />(Board) which has exclusive jurisdiction over reclamation. The Board's jurisdiction does not extend to <br />land use decisions, visual or economic impacts, noise, traffic, dust and other nuisances, or <br />socioeconomic issues. Local government, through the local land use, planning and permitting process <br />handles these issues. The extent of the Board's jurisdiction pertaining to significant, valuable and <br />permanent man-made structures is limited to within two hundred feet of the permit area. The Division <br />believes that your concerns and requests for the Ross Pit would be more properly addressed through <br />local government. <br />Again, we appreciate you taking the time to share your concerns with the Division.
