Box 1750
Canon City, CO 81215
Re: Schwartzwalder Mine, Permit No. M-1977-300, granting of Extension for
Designated Mining Operation Environmental Protection Plan, Amendment AM-02
Dear Mr. Whicker:
The Colorado Division of Reclamation, Mining, & Safety (Division) has received Cotter
Corporation's (Cotter) request for an extension of time to respond to the Division's adequacy
review letter of 14 December 2010 to the Designated Mining Operation Environmental
Protection Plan (EPP), which was submitted to the Division on 31 July 2010 as Amendment
AM-02.
The Division is concerned that granting the extension requested until 12 August 2011 would not
allow sufficient time to perform critical tasks during the shortened field season, such as
monitoring well installation. Therefore, as allowed by Hard Rock Mining Rules 1.4.1(9) and
7.2.3(2)(c), the Division hereby grants an extension to 10 May 2011. Please address the items
listed in the 14 December 2010 adequacy review letter at your earliest convenience, bearing in
mind that if the conditions of the EPP are not addressed to the Division's satisfaction by the
extended deadline of 10 May 2011, enforcement actions may be triggered under Rule 7.2.8.
Feel free to contact me with questions at (303) 866-3567 x8108.
Sincerely,
alj/?
David Bird
Division of Reclamation, Mining & Safety
cc: John Hamrick - Cotter Corporation (via email)
Amory Quinn - Cotter Corporation (via email)
Office of Office of
Mined Land Reclamation Denver - Grand )unction - Durango Active and Inactive Mines
