CI??a eo 7 <br />Kaldenbach, Tom n ?! ?3 <br />From: Daniel E Gray [degray@fs.fed.us] US :GS caw Me <br />Sent: Thursday, December 23, 2010 11:48 AM <br />To: Kaldenbach, Tom <br />Subject: TR123 <br />Tom: I left you a voice message this morning concerning Technical Revision 123. 1 ran all of the revision material <br />through our forest archaeologist (Leigh Ann Hunt) a few weeks ago. There was only a small portion of the activity that <br />had not been covered by previous archaeological surveys and I inspected the ground and communicated to her that there <br />were no heritage resource concerns (I am a certified para-archaeologist). She has already written a letter to the State <br />Historic Preservation Office describing the revision and that no heritage resource concerns were identified and she is <br />waiting for a concurrence letter back from the state indicating that the project can proceed. <br />From a biological standpoint, I mapped the details of the revision and consulted with our district wildlife biologist (Dennis <br />Garrison) and also the contract biologist that Mountain Coal utilizes (John Monarch). Their only concern was with timing <br />limitations for nesting raptors. There was an active nest (Cooper's hawk) to the south of the proposed road that will <br />access the E3-18.5 mdw pad in 2010 about 200 yards south of the proposed road corridor. In addition there is another <br />Cooper's hawk nest that was not active in 2010 but has been active in past years that is just to the north of the E3-45 and <br />E3-48.5 proposed mdw locations. John Monarch will survey these nests again this coming spring (May) and if the nests <br />are active it might trigger the timing limitation for development. What I am doing today is producing a map with the nest <br />locations and measuring the distances from the proposed development to the nest locations and determining if they are <br />even close enough to trigger timing limitations. All of the revision activity is occurring in Coal lease COC-1362 which has <br />a 1/4 mile buffer and a timing limitation of February 1-August 15 for disturbance.
