Resolution:
NATURE OF VIOLATION.
This item is in regards to a Notice of a Possible Violation, corrective actions and civil penalties
for a possible violation of C.R.S. 34-32.5-116(4)(1) for failure to protect areas outside of the
affected land from slides or other damage occurring during the mining operation or reclamation.
CHRONOLOGY.-
November 161h, 2010 - The Division of Reclamation, Mining and Safety (Division) conducted an
inspection of the Barnard Quarry. The Operator, Mr. Chester Barnard was present for the
inspection. During the inspection Mr. Barnard indicated the overburden stockpile was located
outside of the permit boundary. The Division surveyed the disturbed area with a Trimble GeoXT
GPS unit and found the disturbed area to be 6.56 acres in size. The site is permitted for 5.6 acres.
Based on the findings of the inspection, the Division had reason to believe the Operator was in
violation of C.R.S. 34-32.5-116(4)(1) for failure to protect areas outside of the affected land from
slides or other damage occurring during the mining operation or reclamation.
