The Operator, Mr. Chester Barnard was present for the <br />inspection. During the inspection Mr. Barnard indicated the overburden stockpile was located <br />outside of the permit boundary. The Division surveyed the disturbed area with a Trimble GeoXT <br />GPS unit and found the disturbed area to be 6.56 acres in size. The site is permitted for 5.6 acres. <br />Based on the findings of the inspection, the Division had reason to believe the Operator was in <br />violation of C.R.S. 34-32.5-116(4)(1) for failure to protect areas outside of the affected land from <br />slides or other damage occurring during the mining operation or reclamation. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
