The Division has reviewed the additional application materials for CN-01, received on
November 5 and 10, and December 20, 2010, and has determined that the application remains
incomplete for the purposes of filing. The following items must be received before the Division
can consider the application as being filed and commence the technical review.
Page 4 of the application form provides a phone number for the Applicant, (942) 951-
0787, which is different from the phone number provided in the public notice posted at
the proposed mine site, [phone]. These two phone numbers, [phone]
and [phone], also appear on other application documents. Therefore, the
application indicates that either phone number is appropriate contact information for
the Applicant. If this is correct, no response to this deficiency item is necessary. If this is
not correct, please correct either the application form or the public notice posted at the
mine site.
2. The application materials indicate on December 16, 2010, copy of the application was
mailed to the La Plata County Clerk by Certified Mail No. 7010 1060 0000 8447 6703.
Please provide the affidavit or receipt from the County Clerk, required by Rules
1.6.2(1)(c), 1.6.2(2) and 6.4.18, verifying the current copy of the application has been
placed with the La Plata County Clerk.
I. The application materials indicate on December 16, 2010, notice of the 112d application
was mailed to the La Plata County Commissioners by Certified Mail No. 7010 1060 0000
8447 6727. Please provide the proof of notice required under Rules 1.4.5(2)(b)(vi),
1.6.2(1)(a) and 6.4.17.
4. The application materials indicate on December 16, 2010, notice of the 112d application
