The Adequacy <br />Review states that "[i]f the Operator requires additional time to respond to these adequacy issues. <br />a written request for extension must be submitted before the deadline of 10 January 2011." <br />Under Hard Rock/Metal Mining Rule 1.4.1(9). "the Applicant may request that the Office's <br />review time be extended and the Office's decision date reset, not to exceed 365 days from the <br />date the application was filed." Based on your letter, dated August 16. 2010, Cotter's <br />understanding is that the application was deemed "tiled" by the Division on August 13, 2010. <br />Cotter is hereby requesting an extension pursuant to the language of the Adequacy Review and <br />Rule 1.4.1(9) to August 12, 2011, which is 365 days from the date of filing. Per page 8 of the <br />Adequacy Review, Cotter will provide its response to the adequacy issues with sufficient time <br />for the Division to review ahead of the decision deadline.
