OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Acid And Toxic Materials <br />PROBLEM/POSSIBLE VIOLATION: Problem: The diesel storage tank for the crusher is placed directly on the ground with no <br />impermeable liner to prevent leaks from percolating into the ground and into the shallow groundwater. <br />CORRECTIVE ACTIONS: The operator must not store any diesel fuel in the tank until an impermeable liner, of sufficient capacity, is <br />installed. The operator must provide proof of the installation of the liner to the Division's Durango field office by the correction date <br />shown. <br />CORRECTIVE ACTION DUE DATE: 1/31/11 <br />INSPECTION TOPIC: Financial Warranty <br />PROBLEM/POSSIBLE VIOLATION: Problem: The estimated reclamation costs exceed the amount of bond posted for this permit. <br />CORRECTIVE ACTIONS: The operator must post the additional bond amount, as indicated on the updated reclamation cost estimate, <br />within 60 days of the signature date of the bond estimate. <br />CORRECTIVE ACTION DUE DATE: 2/23/11 <br />INSPECTION TOPIC: Revegetation <br />PROBLEM/POSSIBLE VIOLATION: Problem: There are noxious weeds (spotted knapweed and tall whitetop) infesting the site wit] <br />no sign of being controlled, and there is no weed control plan on file. <br />CORRECTIVE ACTIONS: The operator must revise the permit to include a noxious weed control plan that is adequate to monitor <br />and control the noxious weed problems at the site. The weed plan should be developed with assistance from a local weed control <br />authority (such as county extension officer, weed control district, or professional applicator), and must include a commitment to <br />implement the plan in 2011. This permit revision must be received by the Division's Durango field office by the correction date shown. <br />(Note: the fee for a 112c permit technical revision is $216.
