Box 398
Craig, CO 81626
M-llqq0 13

12/23/2010
Division of Mining & Safety
1313 Sherman ST, Room 215
Denver, Co 80203

Dear Sirs:
I received a letter on 12/22/2010 regarding the Ross Pitt located at or near Section 3, Township
6N, Range 90 W, 6th Prime Meridian. I have adjoining land. A right of way to the Ross Pitt goes
through my land.
W"
My concerns and requests are:
1
2
3.
4.
I have a cattle guard entering my property from Highway 394 to the right of way for
James and Kathy Ross's land and to the Ross Pit. There also is a cattle guard at the
North end of my property on the right of way going into James and Kathy Ross's land
and to the Ross Pit. There are regular gates on both ends of the right of way next to the
cattle guards.
Both cattle guards were damaged by the vehicles and heavy equipment that have
traveled through them to and from the Ross Pitt. They were also partially filled in with
gravel. Livestock was able to then jump the cattle guards and get out onto Highway 394
on the South end of the right of way and into my property from James and Kathy Ross's
land or from James and Kathy Ross's property to my property at the North cattle guard.
I recently paid $2,308.00 for a cattle guard to replace one that had been damaged and
filled in with gravel by Bower Brothers. I should not have to continue paying for cattle
guards that have been damaged by the Ross Pit vehicles and heavy equipment and /or
filled in with gravel.
Frequently the regular gates were left open by people traveling through the right of way
to Ross land or Ross Pitt. Livestock then got out onto Highway 394 or to Ross land or
my land. When the gates are left open I want a flag-man in attendance to make sure
the livestock don't get out.
