The Division <br />determined the PAP to be complete for purposes of filing on October 25, 2010. In accordance <br />with the requirements of 2.07.3(2), public notice of the application was published in the San <br />Miguel Basin Forum for four consecutive weeks from October 28 through November 18, 2010. <br />WFC submitted proof of this publication to the Division on December 10, 2010. <br />Upon determining the application to be complete, the Division notified the various agencies with <br />potential jurisdiction over the proposed NHN Mine that the application was under review and to <br />request their review and input. We have received correspondence from the Colorado Division of <br />Water Resources, the Colorado Historical Society, and Montrose County. <br />As required by 2.07.3(5), the period for public comment remained open for 30 days following <br />the last publication of the notice. During the public comment period, which closed at 5:00 p.m. <br />on December 20, 2010, the Division received two letters from concerned citizens (JoEllen <br />Turner and Bob and Beth Starks). <br />The Division previously transmitted the agency responses and public comment letters to WFC, <br />for reference and for posting with the application at the Montrose County Nucla Annex. These <br />five letters are also attached to this adequacy review letter. <br />In accordance with 2.07.4(1), the Division's Preliminary Adequacy Review (PAR) is due within <br />60 days following the completeness date, or December 24, 2010. In the following pages, various <br />adequacy issues are presented for WFC's consideration and response. The issues have been <br />categorized according to the various Rules enumerated in the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining. The Division's preliminary review has not yet been <br />completed, thus the "Part 1" descriptor in the subject line of this letter.
