<br />Mr. Tony Waldron <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado, 80203 <br />REM <br />CQKPEfE YPANT <br />MN=J <br />December 9, 2010 <br />Re: McCann Ditch and Reservoir Company/ RMCC's Request for a Technical Revision <br />of DRMS Permit # M-1987-049 (Bromley Lakes) <br />Dear Tony: <br />The Purpose of this letter is to inform the Division of Reclamation, Mining and Safety (the <br />"Division") that the McCann Ditch and Reservoir Company (the "Company") does not want the <br />south end of the McCann Ditch to be relocated following excavation of the portion of the <br />existing ditch shown on the approved Bromley Lakes Mine Plan. Furthermore, the Company <br />does not want Ready Mixed Concrete Company (RMCC) to maintain the historic groundwater <br />regime associated with the McCann Ditch. <br />The Company understands and agrees that the McCann Ditch will not be relocate as <br />originally contemplated and that RMCC will construct a drainage ditch similar to the proposed <br />McCann alignment shown on the approved Reclamation Plan (Exhibit "F" Sheet 7 attached). <br />The purpose of the drainage ditch will be to collect surface and irrigation runoff water and to <br />discharge that water into the undisturbed section of the McCann Ditch as shown on the attached <br />Reclamation Plan. <br />If you have any questions regarding this letter please do not hesitate to contact me. <br />Sincerely, <br />E.W.
