December 15, 2010 C- 1981- 022/Elk Creek Mine MPB <br />the Hubbard Creek fan site was inspected and remains in good condition (see attached Photo No. 3). <br />diverts clean runoff around the Hubbard Creek fan bench and discharges to an outfall below the site. <br />HYDROLOGIC BALANCE -Rule 4.05 <br />❑Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, <br />4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring <br />4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Site sedimentation ponds were inspected. Ponds A, B, and D were retaining water, but none were discharging. As <br />noted in previous inspection reports these ponds were recently cleaned and coaly material from these ponds was <br />dredged out and hauled to the East Yard Pond to dry. The material is now dry and should be hauled to the refuse <br />pile as planned. The operator has begun excavating the material from the East yard pond but the majority of the <br />pond is still full. This material needs to be removed in the near future so that the original design capacity of the <br />pond is restored. The East Yard Pond with the coal fines and sediment very near the level of the principal spillway <br />is shown in attached Photograph No. 4. To ensure compliance please complete the excavation and removal of <br />coaly material from the East Yard Pond as soon as practicable. The Substation 3 Pond was retaining some water, <br />which was frozen at the surface. Pond F in the Hubbard Creek drainage area is dry and stable. All sedimentation <br />ponds are all well maintained and capable of functioning as intended. Pond embankments, inlets and discharge <br />structures were stable and no problems were noted at any of the sediment pond locations. <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3) <br />Drainage 4.03.1(4)/4.03.2(4) <br />Surfacing and Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) <br />❑Reclamation 4.03.1(7)/4.03.2(7): <br />The Elk Creek Haul and Access Roads, and Hubbard Creek Access Roads were inspected. Road surfaces were <br />damp with some areas of standing water. With exception of Bear Creek, all areas of the mine site were accessible. <br />Road ditches and road culverts along the main haul/access roads are generally well maintained and road surfaces <br />were graded and stable. Cut slopes along these drainages were stable and no slides or other damage was noted <br />along any of the haul/access roads. Bear Creek area and fan site were not accessible due to muddy conditions and <br />would have required chaining up. All other roads throughout the permit area were in good condition. <br />SUPPORT FACILITIES - Rule 4.04: <br />The reclaimed Sanborn Creek portals, the Sanborn Creek fan site, and Substation No. 3 were also inspected. Some <br />recent work has been completed at the Sanborn Creek shaft site to remove concrete foundation material and <br />regrade the area. These areas remain stable and well maintained with no erosion occurring or other problems <br />noted. <br />The reclaimed Somerset Mine B -Seam portals located up in the Hubbard Creek drainage area were inspected. The <br />backfilled portal areas remain stable.
