MEMORANDUM TO FILE <br />Date: December 21, 2010 <br />To: Keenesburg file, Permit C-1981-028 <br />From: Robert Zuber, P.E. (2 V <br />Re: Adequacy review of TR-41, Change to Approved Post-Mining Land Use <br />Coors Energy Company (CEC) submitted an application for Technical Revision Number 41(TR-41) to <br />Permit C-1981-028 on November 1, 2010. This application requests approval of a revision to the post- <br />mining land use of a small portion of the site, approximately 0.1 acres in Area 29. It was received by <br />DRMS on November 4, 2010 and found complete on December 3, 2010. DRMS will issue a decision by <br />February 1, 2011. <br />The statutes and rules that apply to the revision are: <br />• Statute 34-33-116 Technical Revision of Permits <br />• Rule 2.05.05(1) Postmining Land Uses, Surface coal mining activities <br />• Rule 2.10 Maps and Plans <br />• Rule 4.16.3 Alternative Land Uses. <br />The application submitted by CEC complies with those statutes and rules. The proposed activity, natural <br />gas drilling, is: <br />• Compatible with surrounding land use <br />• Will not present actual or probable hazard to public safety <br />• Will not pose actual or probable threat of water flow diminution or pollution <br />• Cause adverse effects to fish, wildlife or habitat. <br />A sufficient map is provided with the application showing the detailed location of the proposed activity, <br />and a general schedule is provided. <br />Furthermore, CEC contacted officials at Weld County Department of Planning Services and confirmed <br />that no zoning permits or separate approvals are required by that agency. <br />
