C-80-006 <br />Dear Rob Zuber: <br />This letter is in response to the Division's Adequacy Review letter dated November <br />5, 2010 concerning Kerr's application request for renewal (RN-06) of Permit No. C-80- <br />006. The following responses are listed in the same sequence as the comments listed <br />(bullets) in the Division's Review letter. <br />Kerr Loadout pond: The ditch serving the primary discharge pipe from the pond <br />was cleaned removing grass/sod with a contracted backhoe on December 6, <br />2010. The ditch was cleaned from the outlet end of the pipe to the downstream <br />monitoring Flume. The outlet end of the discharge pipe was also cleaned to <br />expose the pipe for better viewing. Kerr intends to reclaim the pond during late <br />summer of 2011. <br />• Water monitoring locations: Indication that Map 36 has water monitoring <br />locations is in error given that Map 36 depicts post mining topography whereby <br />the locations are removed during reclamation. Map 1 depicts the water <br />monitoring locations at the Loadout and a .copy is enclosed with this submittal. <br />Table 61 and Page 780.109a were revised for and submitted with Technical <br />Revision No.23 (approved May 2007) and intended to be replacements in <br />Section 780.21 in the permit. For ease of review, copies of Table 61 and page <br />780.109a are enclosed. <br />• Acreage released: After revisiting Bond Release No.4 (SL-04), Kerr concurs with <br />the Division's calculated acreage 100 percent released in the amount of 372.7 <br />acres. However, the total disturbed area as referenced in SL-04 is 401.4 acres <br />(see SL-04, pages 14 -15). SL-04 states, "- - DRMS had concurred with Kerr's <br />values (401.4 ac disturbed) in the Division's 2003 Midterm Review".
