AGREEMENT <br />This agreement is made by an between Ready Mixed Concrete Company a Colorado <br />Corporation, 4395 Washington Street, Colorado 80216 and K.C. and Donna Spier (the <br />Spiers) 14301 Brighton Road, Brighton, Colorado 80601. <br />The Spiers own various structures including a house, domestic well, various out buildings <br />and fencing (the structures) west of Brighton Road. In addition, there are several trees on <br />the Spiers property located in part the Northwest V4 of the Northwest V4 of Section 24 all <br />in Township 1 South, Range 67 West of the 6`h Principal Meridian (PM) in Adams <br />County, Colorado. <br />Ready Mixed Concrete Company has applied to the Colorado Division of Reclamation, <br />Mining and Safety for an Amendment (#002) to its existing Bromley Lakes sand and <br />gravel operation (Permit No. M-1987-049) in order to mine and reclaim property located <br />west of and adjacent to Brighton Road. <br />The Construction Material Rules and Regulations of the Colorado Mined Land <br />Reclamation Board require the Applicant (Ready Mixed Concrete Company) to provide a <br />notarized agreement between the applicant and the person(s) having an interest in any <br />permanent man-made structures located within two hundred (200) feet of the affected <br />land, acknowledging that the applicant agrees to provide compensation for any damage to <br />said structures. <br />Therefore,. Ready Mixed Concrete Company (RMCC) agrees to repair or replace at its <br />expense any damage to the above referenced structures including the domestic well, <br />located within two hundred (200) feet of the affected land, due to its sand and gravel <br />mining operation as approved by the Colorado Mined Land Reclamation Board. In <br />Addition, RMCC will remove and replace any trees that die from the loss of ground water <br />due to pit de-watering. <br />At Spier's request, RMCC will not install a screening berm along the common property <br />boundary with RMCC. <br />In witness whereof, the parties sign and accept this agreement on th day of August <br />2009. <br />READY <br />By. <br />Title: C=_;_4IA( ' <br />
