Pineda <br />CONSENT AGENDA ITEMS Director <br />Date December 20, 2010 Operator Chester Barnard <br />Permit No. M-1996-079 Site Name Barnard Quarry <br />Specialist Michael Cunningham Objecting Party N/A <br />Action <br />Permit application with objections <br />X Violation <br />Extension of Board-ordered deadline <br />Other (specify). <br />Resolution: <br />NATURE OF VIOLATION.: <br />This item is in regards to a Notice of a Possible Violation, corrective actions and civil penalties <br />for a possible violation of C.R.S. 34-32.5-116(4)(1) for failure to protect areas outside of the <br />affected land from slides or other damage occurring during the mining operation or reclamation. <br />CHRONOLOGY.- <br />November 16th, 2010 - The Division of Reclamation, Mining and Safety (Division) conducted an <br />inspection of the Barnard Quarry. The Operator, Mr. Chester Barnard was present for the <br />inspection. During the inspection Mr. Barnard indicated the overburden stockpile was located <br />outside of the permit boundary. The Division surveyed the disturbed area with a Trimble GeoXT <br />GPS unit and found the disturbed area to be 6.56 acres in size. The site is permitted for 5.6 acres. <br />Based on the findings of the inspection, the Division had reason to believe the Operator was in <br />violation of C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the affected land from <br />slides or other damage occurring during the mining operation or reclamation. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
